Agreement to Terms

By downloading, installing, or using Family Travel by Margo Studios (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms are a legally binding agreement between you (“User”) and Margo Studios (“Company,” “we,” “us”) governing your use of the Family Travel mobile application.

1. App Description and Services

Family Travel is a mobile application designed to help families organize travel planning, including:

• Smart packing list generation
• Family profile management
• Travel document organization
• Trip planning and task management

The App operates primarily offline and stores all user data locally on the user’s device.

2. Age Requirements

The App is intended for users who are at least 18 years of age. By using the App, you represent and warrant that you are at least 18 years old. The App does not contain adult content and is designed for family travel planning.

3. User Accounts and Subscriptions

Account Creation

• No account with Margo Studios is required to use the App
• Subscription management is handled through Apple App Store and Google Play Store
• We use Adapty for subscription processing and management

Subscription Terms

• Free Plan: Limited to 2 trips with basic features
• Premium Plan: $9.99/month or $59/year for unlimited trips and advanced features
• Subscriptions are managed through Apple and Google’s respective payment systems
• Refunds are handled according to Apple App Store and Google Play Store policies

4. User Content and Data

User-Generated Content

• Users may upload and store travel-related documents on their devices
• All user content remains exclusively on the user’s local device
• Margo Studios does not access, view, or store user-uploaded content
• Users retain full ownership and rights to their packing lists, trip plans, and other content

Content Restrictions

Users agree not to use the App to store or manage:

• Illegal content or materials
• Content that violates intellectual property rights
• Non-travel related content (though we cannot technically restrict this due to local storage)

Intellectual Property

• Users retain all rights to their user-generated content
• Margo Studios retains ownership of the App’s proprietary algorithms, design, and functionality
• The packing list generation algorithm is proprietary to Margo Studios, but users own their specific generated lists

5. Privacy and Data Protection

Local Storage

• All personal data is stored locally on user devices
• We do not collect, store, or transmit personal user data
• No user content is sent to Margo Studios servers

Third-Party Services

• We integrate with Adapty for subscription management only
• Adapty’s privacy policy governs any data collected for subscription purposes
• No other third-party integrations are present in the App

6. Disclaimers and Limitations of Liability

Warranty Disclaimer

The App is provided “as is” without warranties of any kind, either express or implied. Margo Studios makes no warranties regarding:

• The accuracy or completeness of travel information
• The suitability of packing recommendations for specific trips
• The security of user devices (users are responsible for device security)

Limitation of Liability

To the maximum extent permitted by law, Margo Studios shall not be liable for:

• Any travel-related issues, including missed flights, lost luggage, or travel disruptions
• Device security breaches or data loss
• Damages arising from use or inability to use the App
• Indirect, incidental, special, or consequential damages

Travel Planning Responsibility

Users are solely responsible for:

• Verifying all travel information and requirements
• Ensuring they have appropriate travel documents
• Making travel arrangements and bookings
• Complying with all applicable laws and regulations

7. Intellectual Property Rights

Margo Studios Property

The App and its original content, features, and functionality are owned by Margo Studios and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

User License

Users are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Termination

User Termination

Users may stop using the App at any time and delete the App to remove all local data.

Company Termination

Margo Studios reserves the right to terminate or suspend access to the App for:

• Violation of these Terms
• Fraudulent or illegal activity
• Technical or security reasons
• Business discontinuation

9. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or App usage shall be resolved through binding arbitration in accordance with American Arbitration Association rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

10. Changes to Terms

Margo Studios reserves the right to modify these Terms at any time. Changes will be effective upon posting in the App or on our website. Continued use of the App after changes constitutes acceptance of the modified Terms.

12. Severability
